Welcome to InfluencerPack.shop ("we," "our," or "us"). By purchasing, downloading, or using our digital assets ("Products," "Kits," or "Packs"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not purchase or use our Products.
2. Nature of Products
All products available on InfluencerPack.shop are 100% digital downloads. No physical products will be shipped. Upon purchase confirmation via the blockchain, you will receive immediate access to download files containing AI-generated images, videos, and/or prompt data.
3. License Agreement (Commercial Use)
When you purchase a kit from InfluencerPack.shop, you are not buying the copyright to the images; you are purchasing a non-exclusive, royalty-free, perpetual license to use the assets.
✅ You ARE Allowed To (Permitted Use):
Use the assets for personal or commercial projects (e.g., social media profiles, marketing campaigns, website content).
Create a "Virtual Influencer" persona for yourself or your clients (Agency use is permitted).
Edit, crop, filter, or modify the assets to fit your brand aesthetic.
Use the assets in paid advertising (Facebook Ads, TikTok Ads, etc.).
❌ You ARE NOT Allowed To (Prohibited Use):
Resell, redistribute, or share the raw files/packs "as is" on any marketplace (e.g., Etsy, Gumroad, Fiverr) or peer-to-peer network.
Claim that you are the original creator of the raw AI generation files.
Use the assets for defamatory, illegal, or hateful content.
Create "competing" asset packs derived directly from our source files.
4. Payment Terms (Web3 & Wallet Connection)
Purchases on InfluencerPack.shop are executed via direct interaction with blockchain networks (Web3).
Method of Payment: We accept payments exclusively via Web3 wallet connection (e.g., MetaMask, Phantom, WalletConnect). By connecting your wallet and signing the transaction, you authorize a one-time transaction for the specific amount listed. This is not a subscription.
Transaction Confirmation: Product delivery is automated based on blockchain confirmation. Access to your digital assets will be granted immediately after the transaction is successfully included in a block on the relevant network.
Gas Fees: You are responsible for all network transaction fees (gas) associated with the purchase. These fees are paid to the network miners/validators, not to us, and are non-refundable even if a transaction fails due to network congestion.
Failed Transactions: If your transaction fails on the blockchain (e.g., "Out of Gas" or "Reverted"), you will not be charged the product price by us. However, any gas fees consumed during the failed attempt are lost and cannot be refunded.
5. Refund Policy & Blockchain Finality
Due to the digital nature of our products and the decentralized nature of cryptocurrency payments, all sales are final.
Blockchain Irreversibility: Unlike traditional banking, cryptocurrency transactions are technically irreversible once broadcast to the blockchain. We do not have the technical ability to reverse a payment or issue a "chargeback" once it has been sent.
No Chargebacks: By completing the purchase, you acknowledge that "chargebacks" or "reversals" are impossible in a Web3 environment. You waive any right to dispute the transaction through centralized authorities.
Exception: If a file is corrupted or technically defective, please contact our support team within 7 days of purchase. Upon verifying your transaction hash (TXID) on the blockchain, we will provide a manual replacement link.
6. AI Disclaimer
Our Products are generated using Artificial Intelligence (AI). While we strive for photorealism and high quality:
You acknowledge that minor artifacts, inconsistencies, or imperfections may be present, which are inherent to AI technology.
The persons depicted in the Products are fictional characters and do not represent real human beings. Any resemblance to actual persons is coincidental.
7. Limitation of Liability
InfluencerPack.shop shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our Products. This includes, but is not limited to, loss of profit, data, wallet security, or business reputation. You assume full responsibility for how you use these assets on third-party platforms (e.g., Instagram, TikTok, OnlyFans).
8. Intellectual Property
InfluencerPack.shop retains all ownership rights to the compilation, curation, and original prompt engineering of the Products. Your purchase grants you a license to use the output as defined in Section 3.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.
